1. Scope, obligations and costs

These conditions apply when persons participate in competitions and tenders of

(hereinafter referred to as "the organizer") https://hochbeet.com/. Participation is free and voluntary and without obligation for the participants. Legal recourse is excluded.

2. Eligibility

Residents with permanent residence in Austria, Germany or Switzerland are permitted to participate in competitions and tenders on https://www.facebook.com/Hochbeetcom . A person may only participate once per competition. Automated entries are excluded from participation. The organizer reserves the right to request proof from participants that they have fulfilled the above requirements. If proof is not provided when requested, the participant can be excluded from the competition by the organizer. Furthermore, the organizer reserves the right to exclude participants who violate criminal law, common decency or these game conditions from participation with immediate effect.

3. Rights of third parties

Participants declare that their submission to the competition (for example texts, drawings or photographs) does not violate the rights of third parties, in particular copyrights and personal rights.

If other people were involved in the creation or development of the entry, they must agree to its submission and subsequent publication as part of the competition. The same applies if third parties have been granted exclusive rights to the entries submitted. Even if other people are recognizable in submitted photographs or drawings, their consent must be obtained for the submission and subsequent publication.

4. Settlement

It is not possible to pay out the prize in cash or in kind, or to exchange or transfer it to another person. In the case of prizes in the form of a voucher, the payment of the prize, sale or passing on of the voucher is not permitted.

The winner will be notified within 14 days of the closing date of the competition by email or Facebook message. The organizer reserves the right to publish the winner on https://www.facebook.com/Hochbeetcom .

If the winner does not respond within 14 days, the organizer reserves the right to select a new winner. If the contact details provided are incorrect (e.g. postal or email addresses), the organizer is not obliged to find out the correct addresses. Any disadvantages resulting from providing incorrect contact details (e.g. incorrect postal or email address) are at the participant's expense.

If prizes are found to be faulty or damaged upon delivery, the Promoter must be notified within seven days of the delivery date, otherwise the prize will be deemed to have been accepted as delivered. This does not affect the winners' statutory rights.

If you enter via Facebook, the winner will be notified by the organizer and the winner must contact you within 48 hours to claim their prize. If the winner does not contact you within 48 hours, the organizer reserves the right to forfeit the prize.

Facebook itself has no connection with the competition and is therefore excluded from any liability.

5. Data protection information for the competition

The data entered by participants to take part in the competition will only be used to process and administer the competition and will not be passed on to third parties beyond this – apart from publication, among other things.

The participant agrees that his or her entries for the competition as well as the personal data transmitted (first name, last name, location, photograph or other electronic materials) will be published in connection with the competition, its draw and its processing on https://www.facebook.com/Hochbeetcom and the website https://hochbeet.com/ .

The participant can revoke the publication of his/her personal data during participation or subsequently.

6. Changes to the participation rules and termination of the competition

The organizer reserves the right to change the conditions of participation at any time. Any such change must be announced immediately. The organizer also reserves the right to end or interrupt the competition or prize draw at any time for important reasons without prior notice. This applies in particular to reasons that would disrupt or prevent the competition or prize draw from running as planned.

7. Additional Conditions

Further conditions of participation (e.g. type and duration of the competition, type and amount of the prize) are specified for each competition.

Should individual provisions of the conditions of participation be or become invalid, the validity of the remaining conditions of participation shall remain unaffected. They shall be replaced by an appropriate provision that most closely corresponds to the purpose of the invalid provision.
